- Construction Industry - One (1) or more employees, including the owner of the business who are corporate officers or Limited Liability Company (LLC), there needs to be valid exemptions* for all at that company filed with the State of Florida or valid proof of workers’ compensation coverage for all at that company.
- Non-Construction Industry -Four (4) or more employees, including business owners who are corporate officers or Limited Liability Company (LLC) members, there needs to be valid exemptions* for all at that company filed with the State of Florida or valid proof of workers’ compensation coverage for all at that company.
- Need to continue to keep the exemptions and/or proof of workers’ compensation coverage valid with the State of Florida.
- If your company hires sub-contractors for services, check for proof of valid exemptions and/or workers’ compensation coverage for every individual person who works on the jobsite from that sub-contracting company that your company hired to perform the services.
- Keep up to date documentation on the above.
*Exemptions are available to business owners who opt out of the insurance coverage protections for themselves and who meet the requirements for an exemption.
However, if your company does end up being issued a Stop-Work Order, then be cognizant of the time constraints written on the Stop-Work Order and any other documentation that is attached to the Stop-Work Order such as a Business Records request. Remember that the investigators for the State of Florida do not work for you and will not have your best interest in mind when you are discussing your situation with them.
